

Samek & Rotbert, LLC has extensive experience in working with our clients to assist in Estate Administration. When a person dies, the executor of his or her estate is legally required to go through the process of collecting, managing, and distributing the assets of the descedents Estate. We, at Samek & Rotbert, LLC, work with our clients to gather the assets of the estate, pay the decedent’s debts, pay any applicable Federal and State taxes, and distribute the assets that remain in the estate to the lawful beneficiaries.
Samek & Rotbert, LLC offers counsel to the legally appointed representative to fulfill the requirements of probate. Probate proceedings usually involves filing paperwork, having the register of wills or court appoint someone to manage the estate, paying the debts, distributing the assets, and having the court approve the distribution to the utlimate beneficaries.
In some instances, such as when a will is disputed, more formal probate proceeding may be required. A formal proceeding involves more court oversight and usually requires one or more court hearings. We counsel our clients with respect to their rights and obligations should a will be contested.
Samek & Rotbert, LLC counsels the personal representative to document all of the decedent’s assets. This documentation is often referred to as the inventory.
We also inform the decedent’s creditors that the decedent has died. If the decedent’s probate assets are sufficient to pay the creditors, we counsel the personal representative will pay the claims them from the estate. If the probate assets are insufficient, we work with the personal representative to obtain court approval to determine which creditors should be paid.
If there are any assets left after the creditors have been paid, we counsel our clients as to the appropriate distribution of the assets of the estate according to the will.
